No. 441-1999 for Workplaces
Definition
of “workplace”
A building or part of a building in which one or more employees work, including
employees’ eating and lounge areas, includes a public transit vehicle (other
than a taxi or livery cab) and any other conveyance in which an employee
works.

Where a workplace is also a public place, the provisions of
this by-law respecting public places shall prevail. -
Where a workplace is also a private club, the provisions of
this by-law do not apply. -
No person shall smoke in a workplace, except in a designated
smoking room. -
The designated smoking room must not be more than 25% of the
indoor space; must be fully enclosed and separately ventilated
to the outdoors and have a Health Warning sign posted at the
entrance; and must not be used for any other purpose but smoking.
The employer must:

Prohibit smoking in the workplace except where smoking is permitted
by the by-law -
Prohibit ashtrays and like paraphernalia in area where smoking
is prohibited -
Post No Smoking signs at the entrance to the workplace

Post No Smoking signs in areas where smoking is not permitted

Post Health Warning signs at the entrance to designated smoking
rooms if provided
